Chilterra sues Prolesur

Chilterra filed a lawsuit against Prolesur (a subsidiary of Soprole) before the Tribunal de Defensa de la Libre Competencia for abusive pricing in determining the "base price" for the purchase of fresh milk, arguing that this price would have no economic justification and would therefore be arbitrary.

This is not the first time that a lawsuit has been filed in this market. The precedents have referred, yes, to the policies of bonuses and discounts, but not to the determination of the “base price” by a milk processor such as the defendant, which, in Chilterra’s opinion, constitutes a virtual monopsony in the acquisition and processing of milk.

As with any claim of predatory pricing, the case presents challenges. Crediting what should be considered as “abusive” is not without controversy and discussion. There are not many precedents in Chile.
